Settlement reached with former city employee

ROCHELLE — Rochelle City Council members approved a settlement agreement Monday evening regarding a wrongful termination lawsuit filed by former city employee Lynette Fischer in the amount of $437,500.

The agreement was approved after council members met in executive session.

Speaking before council members at the podium, Attorney Dominick Lanzito, representing the City of Rochelle, clarified the city will be responsible for $87,500 of the total settlement. The Illinois Municipal League Risk Management Association (IMLRMA) will be responsible for the rest.

“Out of the total settlement, only $87,500 will be the city’s portion. It’s approximately a one-year severance,” Lanzito said. “The full amount is not being borne by the taxpayers or the city.”

Following the meeting, Lanzito said on record that the matter has been “amicably resolved between the parties.” Lanzito also said it will be a matter of record in about a week, after which the documents can be obtained through the Freedom of Information Act, or FOIA.

During public comment, Rochelle resident John Kaminski addressed concerns of needing “full disclosure” in the case.

“I think one of you should let the public know what the city’s facing and what their position is on it, and what the position of the plaintiff is on it…there is quite a bit of information that you could and should be giving the public,” Kaminski said, addressing council members. “Let’s be aware, the less you say, the less credibility you have.”

Mayor Chet Olson and Council member Kathy Hollonbeck were absent from Monday evening’s meeting.

Fischer was employed as the city’s human resource manager and was terminated on Aug. 15, 2014.

Fischer filed a lawsuit in Ogle County Court on April 20, 2015, listing four counts against the City of Rochelle. A motion was filed in June 2015 to dismiss Count IV of the complaint.
